Dechlorane Plus Added to EU POPs Regulation

European Commission Delegated Regulation (EU) 2025/1930, published in the Official Journal, amends Regulation (EU) 2019/1021 by adding Dechlorane Plus, a persistent organic pollutant used as a flame retardant, to the EU’s list of banned substances, effective 15 October 2025. Trace amounts are permitted up to 1,000 mg/kg until 15 April 2028, then reduced to 1 mg/kg. This aligns EU law with the Stockholm Convention, requiring businesses to audit supply chains, ensure compliance, and prepare for enhanced testing to meet these environmental and health protections.

Dechlorane Plus is a synthetic chemical used as a flame retardant in plastics, electronics, and other materials. It is persistent in the environment, bioaccumulates in wildlife and humans, and can harm ecosystems and health.

In May 2023, the Parties to the Stockholm Convention decided to amend Annex A of the Convention to include Dechlorane Plus (with specific allowable exemptions). The goal is to eliminate or severely restrict the use of Dechlorane Plus in order to reduce environmental persistence and harmful exposure. This update brings the European Union (EU) law in line with the Stockholm Convention, requiring companies to audit supply chains, ensure compliance, and prepare for stricter requirements.

The European Commission adopted on 15 May 2025 and published on 25 September 2025, Delegated Regulation (EU) 2025/1930, amending Part A of Annex I of Regulation (EU) 2019/1021 (the EU Persistent Organic Pollutants regulation (POPs Regulation)) with respect to Dechlorane Plus. Key points are summarized below.

1. Requirement

The regulation establishes unintentional trace contaminant (UTC) for Dechlorane Plus in substances, mixtures, or articles, with a phased approach to allow for industry adjustment:

3. Implementation

The restrictions on manufacturing, importing, exporting or using Dechlorane Plus start on 15 October 2025 (20 days after publication in the Official Journal). Articles containing Dechlorane Plus already in use before the expiry of a relevant exemption may continue to be used after the exemption ends.
