On 12 May 2025, the United States Environmental Protection Agency (EPA) issued an Interim Final Rule that will delay the implementation date of PFAS reporting to 13 April 2026.
The United States, Environmental Protection Agency (EPA) revisited the implementation date for reporting of per- and polyfluoroalkyl substances (PFAS) and issued an Interim Final Rule on 12 May 2025. This rule moved the required reporting date to 13 April 2026, delaying it by nine months, with no additional modifications to the existing reporting and recordkeeping rules under TSCA (40 CFR Part 705).
When to report
The data submission period begins on 13 April 2026, and ends on 13 October 2026, with an alternate end date of 13 April 2027 for small manufacturers reporting exclusively as article importers.
Note: small manufacturer is defined in 40 CFR 704.3.
Reason for delay
It is the second time the EPA has postponed the submission period.
This change is necessary because the EPA requires more time to prepare the reporting application to collect this data. The Agency is separately considering reopening certain aspects of the rule to public comment.
Date of implementation
DATES: This interim final rule was effective on 13 May 2025. Comments must be received on or before 12 June 2025.

Impact to regulated entities
The extension of the reporting period provides these entities with ample time to prepare for their comprehensive reporting duties.
